Terms of Use

By accessing, browsing, registering for or using the Platform, you represent that you have read, understood and fully agreed to these Terms, to our Privacy Policy and to the other documents referenced herein. If you do not agree with any provision, you must not access or use the Platform.

For the purposes of these Terms, the following definitions apply:

• “Platform”: the website, applications and services operated under the Grape.Date brand.
• “Creator”: a verified user who publishes and monetizes their own content.
• “Subscriber” or “User”: a person who accesses, subscribes to or purchases content from Creators.
• “Content”: all digital material uploaded, displayed or transmitted on the Platform, including images, videos, text, audio and messages.
• “Payout”: the net amount owed to the Creator after deduction of the Platform commission.

The Platform is intended exclusively for adults and contains sexually explicit material. Access is strictly prohibited to anyone under 18 (eighteen) years of age or under the applicable age of majority in the user's jurisdiction, whichever is greater. No person under 18 may access the Platform, create an account, subscribe, purchase content or become a Creator.

By using the Platform, you represent and warrant, under penalty of law, that:

• You are at least 18 years of age and have reached the age of majority in your jurisdiction;
• You have full legal capacity to enter into this agreement;
• You are not located in a jurisdiction where adult content is prohibited;
• You will not allow minors to access your account or any Content.

Before enabling any form of monetization, every Creator must mandatorily complete the manual identity verification process (KYC — Know Your Customer) conducted by the Grape.Date team. No Creator may receive funds without prior KYC approval.

The KYC process requires, at a minimum:

• A valid, government-issued photo ID document;
• One or more verification selfies, including, where requested, a selfie holding the ID document and/or a code of the day;
• A match between the registration data, the ID document and the ownership of the receiving account;
• Confirmation that the Creator is the person depicted and/or holds all rights over the published Content.

The Platform must be used only for lawful purposes and in accordance with these Terms. The following is expressly prohibited:

• Uploading, soliciting or distributing any content involving minors, whether real, simulated or appearing to be underage, in any form;
• Uploading non-consensual content, real violence, human trafficking, bestiality, incest or any illegal acts;
• Uploading third-party Content without authorization or that infringes copyright, image, personality or trademark rights;
• Circumventing payment mechanisms or paywalls, as well as capturing, recording, reselling or redistributing Creators' Content;
• Using bots, scrapers or automated means to collect data or Content;
• Harassing, threatening, extorting or impersonating another person;
• Using the Platform for money laundering, fraud or the financing of illicit activities.

When creating an account, you are responsible for:

• Keeping your access credentials confidential;
• Providing true, accurate and up-to-date information;
• Maintaining a single account, unless expressly authorized by the Platform;
• Notifying us immediately of any unauthorized use of your account;
• Being responsible for all activities carried out through your account.

The Creator remains the sole and rightful owner of all intellectual property rights over the Content they publish. Grape.Date does NOT claim ownership of Creators' Content.

By publishing Content, the Creator grants Grape.Date a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, transcode, reproduce, technically adapt, stream, publicly display and distribute the Content, for the sole purpose of operating, providing, promoting and improving the Platform.

This license remains in effect while the Content is published and may survive for a reasonable period after its removal, for backup purposes, compliance with legal obligations and dispute resolution. The Creator represents and warrants that they hold all necessary rights and that every person depicted was over 18 years of age and expressly consented to the production and publication of the material.

Grape.Date is committed to ensuring that only lawful adult content is published on the Platform. Before any Content is published or monetized, the age (18+) and consent of every person depicted are verified through valid government-issued identification, and the Content is reviewed against the Platform's policies.

Each Creator represents and warrants that they hold all necessary rights and consents, that every person appearing in their Content was at least 18 years of age at the time of production, and that they will provide the required age and consent documentation for themselves and for every additional person appearing in their Content. Grape.Date may refuse, restrict, or remove any Content that does not satisfy these requirements.

Grape.Date respects the intellectual property rights of third parties and adopts a notice-and-takedown policy. If you believe that any Content infringes your copyright or is illegal, send a notice to [email protected] that must contain:

• Identification of the work or right allegedly infringed;
• The exact and specific links (URLs) of the infringing Content on the Platform;
• Proof of ownership or that you are authorized to act on the owner's behalf;
• Your full contact details (name, email, phone and address);
• A good-faith statement that the use is not authorized by the owner, its agent or the law;
• A statement, under penalty of liability, that the information provided is accurate;
• The physical or electronic signature of the rights holder or their legal representative.

Valid notices will be processed promptly and the infringing Content removed. Grape.Date maintains a policy of terminating the accounts of repeat infringers.

Grape.Date retains a fixed commission of 20% (twenty percent) on the gross revenue of all transactions carried out on the Platform, including subscriptions, pay-per-view content, tips and paid interactions. The remaining 80% (eighty percent) constitutes the Payout owed to the Creator.

Payments and Payouts are processed through the provider Safe2Pay. Payouts are made available on a daily basis (daily payouts), subject to bank clearing and the applicable rules of the payment provider.

The Creator is solely responsible for the assessment and payment of all taxes levied on their earnings.

Given that the Content is digital, intangible and consumed immediately upon access, all purchases — including subscriptions, tips and unlockable content — are FINAL, DEFINITIVE and STRICTLY NON-REFUNDABLE, to the maximum extent permitted by applicable law.

Before disputing any charge, the Subscriber must contact Platform support to seek an amicable resolution.

The Platform is provided “as is” and “as available”. The hosting, distribution and payment infrastructure is operated by third parties (including Railway, Cloudflare and Safe2Pay), and Grape.Date does not warrant uninterrupted, error-free or fully secure operation.

Grape.Date acts as a technological intermediary and is not a party to the relationships established between Creators and Subscribers, and is not responsible for the conduct of users nor for the Content they generate.

To the maximum extent permitted by law, Grape.Date's total liability to the user shall be limited to the amount the user actually paid to the Platform in the 3 (three) months preceding the event giving rise to the liability.

Grape.Date may, at its sole discretion and without prior notice, suspend or terminate the access of any user who breaches these Terms, publishes illegal content or engages in fraud.

In cases of fraud, use of false documentation or abusive chargebacks, accumulated balances and funds may be withheld and declared forfeited, without prejudice to any other applicable legal measures.

Grape.Date reserves the right to modify these Terms at any time. Changes take effect upon their publication on this page. Continued use of the Platform after publication constitutes acceptance of the revised Terms. Periodic review of this document is recommended.

These Terms are governed by the laws of the Federative Republic of Brazil, including the Brazilian Internet Framework Act (Law No. 12,965/2014), the Consumer Protection Code and the General Data Protection Law — LGPD (Law No. 13,709/2018). The courts of the District of São Paulo, State of São Paulo, Brazil, are elected as the competent forum, waiving any other, however privileged, to resolve any disputes arising from these Terms.
